ICE BARREL PRODUCT WARRANTY

When your Ice Barrel is delivered, it has already been tested and inspected according to our quality standards. However, on the off chance that something isn’t quite right when your Ice Barrel arrives like a broken valve or a manufacturing defect, we offer a limited lifetime warranty to cover these kinds of issues. For Ice Barrels or accessories damaged in shipping, please contact our customer service team with photos and information via the form below. A team member will review and offer a credit or replacement based on the extent of the damage.

We guarantee that your Ice Barrel will not crack and will remain free from material defects so long as the barrel is used for its intended purposes and is subject to reasonable maintenance. The warranty does not cover cosmetic issues (i.e. fading, scratches, etc.) resulting from normal wear or dirt, water retention, internal/external surface contamination from exposure to environmental conditions, and inclement weather, including but not limited to storms, tornados, hurricanes, hail, sleet, ice, moisture, rain, flooding, snow, sun, and wind.

If your product is covered by this warranty, we will repair or replace your product with a new one free of charge (excluding any applicable shipping and handling charges). If your product has been discontinued, you’ll receive a replacement of equal or lesser value.

Please note that Ice Barrel is made from LLDPE (Low Linear Density Polyethylene), this will fade over time if left in direct sunlight. We do our best to combat fading with our UV formula and protective cover. There’s no warranty against fading, as some of the materials we use may form natural signs of aging with use. If this is the case for you, please contact us via the form below and we will still figure out a way to help.

This warranty does not cover damage resulting from or caused by improper installation, relocation, accident, misuse, abuse, unauthorized modification, or failure to provide reasonable and necessary maintenance. This warranty does not also cover damage caused by proper or improper use of our products to any surrounding surfaces, structures, or furnishings. This includes, but is not limited to, discoloration or damage to a patio or deck surface, furniture, house, or any other structure. Ice Barrel Inc is held harmless for any injury or death caused by the misuse of this product.

THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO ORAL AGREEMENT, GUARANTEE, PROMISE, REPRESENTATION, OR WARRANTY SHALL BE BINDING. IN NO EVENT WILL ICE BARREL INC BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES EVEN IF ICE BARREL INC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF ICE BARREL INC HAS KNOWLEDGE THAT FAILURE TO PERFORM COULD CAUSE CONSEQUENTIAL ECONOMIC LOSSES. IN ANY EVENT, CUMULATIVE DAMAGES FOR BREACH OF THIS WARRANTY WILL BE LIMITED TO THE AMOUNT ACTUALLY PAID TO ICE BARREL INC FOR THE PRODUCT. THIS PARAGRAPH SHALL APPLY TO ALL ACTIONS RELATED TO THE PRODUCT, WHETHER BASED ON TORT, CONTRACT, OR OTHER THEORIES.

The warranty covers the original consumer purchaser only and covers non-commercial use of Ice Barrel. Ice Barrel is intended for personal non-commercial purposes. If the product is to be used for any commercial purpose or for the benefit of any third party, express prior written consent of Ice Barrel Inc must be obtained.

ICE BARREL CHILLER – TERMS OF USE

Welcome to Ice Barrel, Inc. These Terms of Use (“Terms”) govern your access to and use of the Ice Barrel Chiller (“Chiller”) and related services provided by Ice Barrel, Inc. Please read these terms carefully before using the Chiller.

1. Acceptance of Terms:
   1. By using the Ice Barrel Chiller, you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use the Chiller.
   2. Ice Barrel, Inc. reserves the right to modify or update these Terms at any time. Your continued use of the Chiller after any such modifications constitutes acceptance of the revised terms.
2. Use of the Chiller:
   1. The Ice Barrel Chiller is intended for personal, non-commercial use in accordance with its intended purpose as outlined in the product documentation. Any unauthorized use, modification, or tampering with the Chiller is strictly prohibited.
   2. You agree not to use the Chiller in a manner that violates any laws, regulations, or third-party rights.
3. User Responsibilities:
   1. Proper Use: You are responsible for the proper installation, setup, and maintenance of the Ice Barrel Chiller as per the instructions provided in the user manual.

6. Warranty, Support, and Disclaimers:

7. Limitation of Liability:

   2. This limitation of liability applies to damages related to personal injury, property damage, loss of profits, loss of data, or any other losses.
8. Termination:
   1. Ice Barrel, Inc. reserves the right to terminate or suspend your access to the Ice Barrel Chiller without prior notice for violations of these Terms of Use or applicable laws.
9. Governing Law:
   1. These Terms of Use shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law principles.
10. Miscellaneous:
    1. Entire Agreement: These Terms constitute the entire agreement between you and Ice Barrel, Inc. regarding the Ice Barrel Chiller, superseding any prior agreements or understandings.
    2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

ICE BARREL CHILLER –DISCLAIMER

1. Product Use: The Ice Barrel Chiller, manufactured and distributed by Ice Barrel, Inc., is intended solely for the purpose of maintaining and chilling water within compatible Ice Barrels designed for cold plunge experiences. It is expressly not intended for any other use, application, or modification beyond its intended design and function as specified in the product documentation. Your use Ice Barrel Chiller is governed by the Ice Barrel Chiller terms of use, which is available here. By using the Ice Barrel Chiller, users acknowledge that they have read, understood, and agreed to comply with the terms and conditions outlined in Chiller Terms of Use.
2. Safety Precautions and User Responsibility: Users must thoroughly read and strictly adhere to all safety instructions, warnings, and precautions provided in the Ice Barrel Chiller’s user manual and accompanying documentation. Failure to follow these guidelines may result in personal injury, property damage, or operational issues with the Chiller. Improper use, modification, or tampering with the Chiller may result in hazards or damage for which Ice Barrel is not liable.
3. Installation and Maintenance: Proper installation, regular maintenance, and periodic inspections of the Ice Barrel Chiller are essential to ensure safe and optimal performance. Users are responsible for ensuring that the Chiller is installed correctly and maintained according to the guidelines outlined in the user manual.
4. Water Filtration: If the Ice Barrel Chiller includes water filtration capabilities, it is designed to improve water quality within the Ice Barrel. However, users should understand that no water filtration system can guarantee the complete removal of all contaminants. It is recommended to use potable water sources for best results.
5. App Integration: The Ice Barrel Chiller may integrate with the Ice Barrel mobile application developed by Ice Barrel, Inc. Users must follow the app’s instructions and guidelines for proper integration, configuration, and usage to leverage advanced control and monitoring features effectively.
6. Limited Warranty: Ice Barrel warrants the Ice Barrel Chiller against defects in materials and workmanship under normal use conditions as specified in the product documentation provided with each unit and which is available for a period of 1 year from the date of purchase. The warranty period, coverage details, exclusions, and procedures for warranty claims are outlined in the official warranty documentation. Users are encouraged to review and understand these terms before using the product.
7. Liability Limitation: Ice Barrel, Inc., its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use, misuse, or inability to use the Ice Barrel Chiller, even if advised of the possibility of such damages. 10. Compliance and Modifications: The Ice Barrel Chiller is designed and manufactured to comply with relevant industry standards and regulatory requirements. Users are strictly prohibited from making any modifications, alterations, or unauthorized repairs to the Chiller that may compromise its safety, performance, or compliance status. Such actions will void warranty coverage and may pose safety risks.

ICE BARREL CHILLER – LIMITED WARRANTY

1. Introduction: Ice Barrel Inc. (“Ice Barrel”) is committed to providing high-quality products and services to our valued customers. We hereby extend the following comprehensive express warranty to the original Buyer who directly purchased the Chiller from Ice Barrel, whether natural or corporate. This warranty outlines the terms and conditions governing the purchase and use of our Chiller products.
2. Warranty Coverage: Ice Barrel’s sole and exclusive obligation under this Warranty is to credit the account of the original Buyer for the amount of the purchase price paid to Ice Barrel for the Chiller or the component parts (the “Component Parts”), found upon inspection by Ice Barrel to be inoperative solely due to a defect in material or workmanship, or damage resulted from the manufacturer, excluding customer damage, and received by Ice Barrel within twelve (12) months from the date of purchase, as determined from the Chiller code plate/serial label. Chiller units must be returned with the compressor and motor to qualify for Warranty disposition. Replacement parts for manufacturer-caused damage are covered under this Warranty for one (1) year from the date of purchase.
3. Warranty Claim Process: To file a warranty claim, the original purchaser must provide proof of purchase (receipt or invoice) indicating the date and place of purchase from an authorized Ice Barrel retailer or distributor. All warranty claims must be submitted within the warranty period specified above. 4. Warranty Remedies: Ice Barrel may, at its discretion, repair or replace the defective Chiller with a new or refurbished unit during the warranty period. The warranty remedies are limited to the repair or replacement of the Chiller and do not include any other damages, costs, or expenses.
5. Limitations and Exclusions: The LIMITED WARRANTY contained herein is subject to the following limitations and exclusions:
   (i.) Ice Barrel shall not be liable for any costs or expenses incurred by any other person concerning the repair or replacement of any Chiller or Component Part
   (ii.) This Warranty does not cover any Chiller or Component Part that becomes inoperative due to:
   1. The failure of, or any defect in, any refrigeration system, refrigeration device, or any component part thereof using such Chiller or Component Part not attributable solely and exclusively to such Chiller or Component Part,
   2. System processing, design, or installation, or
   3. Failure to follow any directions, manuals, and precautions provided by Ice Barrel.

   (iii.) Ice Barrel reserves the right to make charges against the Buyer for any in-Warranty return where Ice Barrel’s inspection of the Chiller or Component Part indicates no defect in material or workmanship.
   (iv.) Ice Barrel shall not be liable for any transportation costs other than the Freight Allowance described in Ice Barrel’s General Policy and Return Goods Procedure for Original Equipment Manufacturers Only, available upon request
   (v.) This Warranty does not extend to any loss of, or damage to, any Chiller or Component Part attributable to normal wear and tear, cosmetic damages, scratches, dents, or damages due to transportation, storage, or handling of the same.
   (vi.) This Warranty will automatically become void with respect to any Chiller or Component Part on which the Ice Barrel serial number or Ice Barrel code plate/serial label is missing or rendered illegible.

6. Modifications and Improvements: Ice Barrel reserves the right to make changes in the design of, and to make additions to and improvements in, the Chiller or Component Part without imposing any obligations upon Ice Barrel to make changes in the design of, or additions or improvements to Ice Barrel’s Chiller or Component Part previously manufactured.
7. Exclusive Remedy and Disclaimer: The LIMITED WARRANTY SET FORTH HEREIN IS BUYER’S EXCLUSIVE REMEDY AGAINST ICE BARREL AND ITS SUPPLIERS RELATING TO THE PRODUCTS, WHETHER IN CONTRACT OR IN TORT OR UNDER ANY OTHER LEGAL THEORY. ALL OTHER WARRANTIES, EXPRESS, STATUTORY, OR IMPLIED, INCLUDING WITHOUT LIMITATION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, ARE DISCLAIMED AND EXCLUDED BY ICE BARREL. ICE BARREL SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE, REPAIR, OR PERFORMANCE OF THE PRODUCTS. THE SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF ANY AND ALL WARRANTIES AND THE SOLE REMEDIES FOR ICE BARREL’S LIABILITY OF ANY KIND (INCLUDING LIABILITY FOR NEGLIGENCE) WITH RESPECT TO ANY PRODUCT OR COMPONENT PART COVERED BY THIS WARRANTY SHALL BE LIMITED TO CREDITING BUYER’S ACCOUNT FOR THE AMOUNT OF THE PURCHASE PRICE THAT BUYER HAS PAID TO ICE BARREL.
8. SAFETY PRECAUTIONS:
   (i.) Understanding the Risks: The Products are integral components of complex refrigeration and air conditioning systems, which are designed to operate under specific pressure conditions. Due to the inherent risks associated with high-pressure gases, EXTREME CAUTION must be exercised when installing, maintaining, or operating these systems.
   (ii.) Pressure Limitations: It is imperative that these Products are not applied to systems with pressures that exceed those recommended by Ice Barrel. The correct and safe operation of these Products depends on adherence to these specifications.
   (iii.) Testing and Pressurization: UNDER NO CIRCUMSTANCES should these Products be leak tested or pressurized beyond the pressure recommendations stipulated by Ice Barrel. All testing must be performed in accordance with standard industry practices and safety standards, ensuring the use of appropriate equipment and safety gear.
   (iv.) Consequences of Non-Compliance: FAILURE TO HEED these warnings and directions may result in severe outcomes, including lethal explosions, ruptures, concussions, gas poisoning, and other serious injuries. Furthermore, such failures may lead to extensive property damage and operational downtime.
   (v.) Training and Qualifications: Installation and service personnel must be properly trained and qualified to work with high-pressure refrigeration systems. This includes a thorough understanding of the Products, the refrigeration system, and the appropriate safety protocols.
   (vi.) Emergency Procedures: It is essential that all operational facilities have emergency procedures in place, which are to be followed in the event of a pressure-related incident. These procedures should be regularly reviewed and practiced by all personnel.
   (vii.) Liability: Compliance with these safety precautions is not only crucial for the safety of personnel and property but also a requirement for the validity of this Warranty. Ice Barrel disclaims all liability for incidents and damages resulting from the failure to follow these precautions and reserves the right to void the Warranty in such cases.
9. Limitation of Liability:
   (i.) Limitation of Damages. Ice Barrel’s liability under this Warranty shall be limited to the repair or replacement of defective products as stated herein. Ice Barrel expressly excludes liability for indirect, incidental, or consequential damages, including but not limited to, loss of use, loss of profits, loss of revenue, or loss of business opportunity. The original Buyer acknowledges that they are not entitled to claim for damages beyond the repair or replacement of the product or crediting of the purchase price.
   (ii.) Indemnification. The Buyer agrees to indemnify, defend, and hold harmless Ice Barrel from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of the Buyer’s use, misuse, or improper installation of the Chiller, provided that such use, misuse, or installation is not solely due to the fault of Ice Barrel.
   (iii.) Excusable Delays: Ice Barrel shall not be liable for any delay or failure to perform its obligations under this Warranty due to circumstances beyond its reasonable control, including but not limited to, natural disasters, acts of war or terrorism, labor disputes, or supply chain disruptions. Such excusable delays shall extend the Warranty period by the duration of the delay.
   (iv.) Procedures for Defaults or Cancellations: In the event of a default by Ice Barrel, the Buyer must provide written notice of the default to Ice Barrel, allowing a cure period of thirty (30) days. If Ice Barrel does not remedy the default within this period, the Buyer may cancel the order or any part thereof. If cancellation is due to a breach of this Warranty by Ice Barrel, the Buyer shall be entitled to a full refund for the affected Chiller or Component Part. Cancellation by the Buyer for any other reason will be subject to Ice Barrel’s standard cancellation policy and may incur cancellation charges as applicable.
10. Governing Law: This limited warranty is governed by the laws of Delaware, excluding its conflict of law principles.
11. Additional Terms:
    (i.) This limited warranty is valid only for the original purchaser of the Chiller and is not transferable.
    (ii.) Ice Barrel reserves the right to modify or terminate this limited warranty at any time with notice to customers.
